Schwartzwalder Mine Perniit Amendment Application EXHIBIT A - Legal Description The affected land is located in Jefferson County, Colorado, in Section 25 of Township 2 South, Range 71 West, 6 Principal Meridian. The affected or potentially affected areas have changed from the previous mine reclamation plan. The affected area is being expanded by 14.83 acres to accommodate anticipated mitigation and monitoring activities. The change in affected area is the reason for this mine plan revision. Amendment 1 to the Mine Reclamation Plan (August 1, 2001) listed approximately 46.12 acres of affected land associated with Pennit No. M -1977 -300. An additional 8.61 acres are associated with Pennit No. M- 2001 -036, for a total of 54.7 acres. The exact acreage has been updated to match the detailed drawing (Exhibit C), which shows 46.33 acres of affected land associated with Pennit No. M- 1977 -300, and 8.61 acres associated with Pennit No. M- 2001 -036, for a total of 54.93 acres of existing affected area in the Mine Permit. An additional 14.83 acres are being added to the affected or potentially affected area associated with permit M -1977 -300, as shown in Table A -1 (below) and in the map in Exhibit C. With the addition of Tracts Al through A7, the acreage associated with Permit No. M- 1977 -300 will be 61.16 acres.
