February 9, 2012 C- 1980- 007/West Elk Mine JRS <br />ROADS (cont.): - The access road to the Sylvester Gulch facilities area was covered with some snow but it was <br />stable at the time of the inspection. The road appeared to be well maintained. There was some equipment parked <br />along the edge of the road in several wide spots. This equipment belongs to Kiewit and will be removed from the <br />site when they have completed their work. <br />- The haul road to the RPEE has been completed. The road was well constructed and stable. Mountain Coal will <br />provide an as -build certification for the road in a future technical revision. <br />- The access road to the portals and material storage bench was stable and well maintained. There was no rutting <br />on the road and no erosional problems were noted. <br />SLIDES and DAMAGE - Rule 4.12: <br />- The ST -02 pad slide area remains stable. There were no problems noted at this site during the inspection. The <br />reclaimed outslopes of the area will be seeded this spring, as conditions permit. <br />- The operator has basically completed the slide remediation at the RPEE haul road area. The only remaining <br />work is to remove the dirt that was pushed up along the lower portion of the rock filter blanket below the haul <br />road. This material will be removed to allow for the unimpeded flow of water through the filter blanket. Now that <br />remediation work is done, Mountain Coal will need to submit a technical revision containing a detailed description <br />of the work completed and an as -built of the area. (This revision will also include the same information for the <br />ST -02 slide area.) <br />SUPPORT FACILITIES - Rule 4.04: <br />- The coal stockpile areas were stable and well maintained at the time of the inspection. All of the road spurs <br />around the coal stockpiles were well maintained and stable. <br />- The Sylvester Gulch facilities area was stable and well maintained at the time of the inspection. No problems <br />were noted with any of the pad areas or structures. The large pile of snow that was located on the shaft lay down <br />area was gone. <br />- The coal loadout area is across Colorado Highway 133. This area was well maintained and stable at the time of <br />the inspection. The portal area and the upper material storage bench areas were well maintained and stable. No <br />problems were noted at either of these areas. <br />SIGNS AND MARKERS — Rule 4.02: <br />- The mine ID signs were in place at the entrances to the main mine site, the loadout and the NSSA, as required. <br />All of the subsoil and topsoil stockpiles that were visible had their appropriate signs in place. <br />DOCUMENTS RECEIVED: The 4Q I I DMR's and Amended DMR's and a copy of the 2011 Reclamation <br />Project Photographs were hand delivered at the time of the inspection. <br />This concludes the 9 February 2012 complete inspection report for the West Elk Mine. <br />Number of Partial Inspection this Fiscal Year: 8 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 4 of 8 <br />
