The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on February 23, 2012
an application to revise coal mining operations at the New Horizon Mine was considered complete
for the purposes of filing. The revision was submitted by Western Fuels - Colorado, LLC. All
review and comment periods as provided in the Act and the Regulations initiate from this date of
filing.
A soil Sampling and Analysis Plan (SAP) was developed to evaluate the properties of undisturbed,
stockpiled, and redistributed soils on the Morgan property. This SAP was approved, and
incorporated into the New Horizon Mine permit, under Technical Revision No. 61 (TR -61) on
November 21, 2011. Sampling of the soils was conducted on November 22, and December 12 -
14, 2011. Certain modifications to the approved SAP were made in the field; the application for
Technical Revision No. 62 (TR -62) has been submitted to provide formal documentation of the
changes that were made.
The Surface coal mining operation is on land located approximately 1.7 miles Northwest of Nucla,
Colorado. The permit area is further described as follows:
Sections 25 and 36, Township 47 North, Range 16 West; Section 31, Township 47 North, Range
15 West; Section 6, Township 46 North, Range 15 West; and Section 1, Township 46 North,
Range 16 West.
The above - mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla.
