Pineda <br />Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on February 23, 2012 an <br />application to revise coal mining operations at the New Horizon Mine was considered complete for the <br />purposes of filing. The revision was submitted by Western Fuels - Colorado, LLC. All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />A soil Sampling and Analysis Plan (SAP) was developed to evaluate the properties of undisturbed, <br />stockpiled, and redistributed soils on the Morgan property. This SAP was approved, and incorporated into <br />the New Horizon Mine permit, under Technical Revision No. 61 (TR -61) on November 21, 2011. Sampling <br />of the soils was conducted on November 22, and December 12 - 14, 2011. Certain modifications to the <br />approved SAP were made in the field; the application for Technical Revision No. 62 (TR -62) has been <br />submitted to provide formal documentation of the changes that were made. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed <br />complete. At the time of publication of this notice, the applicant is additionally required to place a copy of <br />this application at the Montrose County Courthouse Nucla Annex, 300 Main, Nucla, CO 81424, and at the <br />Division office.
