Box 535 <br />3737 Highway 133 <br />Somerset, CO 81434 <br />Re: Elk Creek Mine (Permit No. C- 1981 -022) <br />Minor Revision No. 98 (MR- 98) Ownership and Control and Bonding Issues <br />Dear Mr. Kiger: <br />Enclosed you will find the Division of Reclamation, Mining and Safety's Decision Form for <br />Minor Revision No. 98 at the Elk Creek Mine. <br />Documentation must be submitted to the Division demonstrating that a copy of the approved <br />revision application was sent to the Office of Surface Mining and the Bureau of Land <br />Management. The material should be sent within 15 days of final approval. <br />Oxbow Mining, LLC (OMLLC) submitted MR -98 to address two issues raised by CDRMS's <br />midterm review of the Elk Creek Mine. For the first issue, OMLLC submitted updated <br />Ownership and Control information which is approved with this revision. For the second issue, <br />DRMS will initiate the bond reduction process as described in Rule 3.02.2(4) to address the <br />reduced costs required for the performance bond.
