Exhibit D — Reclamation Plan (Rule 6.3.4) <br />Page 2 <br />The application indicates that the excavated area will be reclaimed as a recharge pond, and that the pond <br />margins will have raised earthen berms. You have stated that the pond in- slopes will have final gradients <br />of 2 horiz:1 vert. Please provide more detail concerning the berms in terms of height (above surrounding <br />grade), gradient of the berm's out - slope, and width at the top of the berm. A cross - section diagram may <br />help provide this information. <br />If there is soil available to use in revegetating portions of the site, please state what the replaced depth <br />will be, and clearly describe the areas where it will be replaced (such as how much of the pond slopes <br />and/or any of the unexcavated areas). <br />The plan states that "Pond slopes will be seeded with grass mix." Please provide details of the seed mix <br />that will be used, such as which species, the seeding rates, and the method of sowing the seed. The <br />NRCS may be of assistance in obtaining a recommended seed mix. <br />Please state whether there will be mulch and/or fertilizer applied for the revegetation portion of the <br />reclamation plan. <br />At most times during the excavation of the site, there will be reclamation tasks to perform, in order to <br />bring the site to its "reclaimed" condition (which is described in the reclamation plan). Please provide <br />your best estimate of the necessary tasks and the costs to perform them. Wherever possible or applicable, <br />please include details such as the types of equipment used, quantities and distances for materials moved, <br />seeding quantities (such as acreage, pounds of pure live seed, etc.). <br />Our office will also prepare a reclamation cost estimate that will be sent to you to review. When the <br />figures are finalized, they will be used for the bond amount that is to be submitted by you. Please note <br />that the bond must be submitted to our Denver office, in care of Barbara Coria, on a form that is on our <br />website (www.mining.state.co.us). There are several types of bonds accepted by the Division. <br />I encourage you to begin looking now into which type of bond you will provide, so that any delays in <br />submittal or acceptance can be minimized. The 110 permit will not be issued until all the adequacy issues <br />identified above have been addressed, and the Denver office has accepted your bond. (Recall, there is a <br />Board- ordered deadline of February 29, 2012 for obtaining your permit.) <br />Exhibit I — Proof of Filing with County Clerk <br />Please be aware that all additional materials related to this application that you submit to the Division <br />(such as responses to the items in this letter) must be available for public review at the county clerk's <br />office. Please promptly file a copy of all such additional materials at the county clerk's, and send me the <br />receipt for those filings. <br />As always, please send two sets of all materials directly to me.
