Action Required to Demonstrate Compliance For Intermittent Status of the <br />Neglected Mine, Permit No.M1981 165. <br />I apologize for the tardiness of my response; I lost my mother on the 19 of January and <br />have been dealing with the associated matters of her death. <br />I have consulted with Bob Oswald in the Durango office ref. your request and he <br />advised me to set out the facts as they have existed since the operation under the <br />current permits began. I believe that the intermittent status of the "seasonal <br />operation" of the Neglected Mine was either implied or stated in the original permit <br />application. The mine has never operated longer than 180 days per year because of <br />the altitude where it is located and the impassability of the access road to the mine site <br />do to snow pack. It is a rare spring when we can access the site prior to July and you <br />should expect to become snowed in any time after mid September. The US Forest <br />Service controls the access to the site and keeps the gates on the main road closed <br />until they make the determination as to when access on the main road is to be granted. <br />As for the mining activity at the site, there has been only two seasons of non activity by <br />the "definition" given in your letter. Down seasons were (summer of 2010 and 201 1). <br />This season (2012) we are expecting to extract and concentrate material from the <br />underground workings. <br />
