MINE ENGINEERING CIVIL ENGINEERING
MINE RECLAMATION CONST. MANAGEMENT
February 16, 2012
J. E. STOVER & ASSOCIATES, INC.
Janet H. Binns
Division of Reclamation, Mining and Safety
1313 Sherman St., Room 215
Denver, CO 80203
ONIV
J gafel
Dear Ms. Binns: p \N - - .
The DRMS' letter dated February 10, 2012 transmitted its adequacy review for
the referenced technical revision. On behalf of New Elk Coal Company, (NECC)
following are its responses to the DRMS' comments and concerns:
Re: New Elk Mine Permit C- 1981 -012
TR -62 Adequacy Response #1
Cell Repeater Installation
2352 NORTH 7 STREET, UNIT B
GRAND JUNCTION, COLORADO 81501
PHONE: (970) 245 -4101, FAX 242 -7908
1. DRMS: Revised Map 12 does not show culverts or ditches. Approved Map 14
in the PAP shows the currently approved culverts and ditches. The slurry line
light -use road crosses Ditch D34B. How will the road cross the ditch? Will there
be a culvert in this location, or will vehicles drive through Ditch D34B. Map 14
shows culvert C52 west of the proposed slurry line light -use road crossing ditch
D34B. On -site inspection with Bobby Steele of NECC, on January 11, 2012,
found that culvert C52 has been removed from Ditch D34B.
NECC could use the same size culvert as C52 for the slurry line crossing of ditch
D34B. However, if a culvert is installed for the crossing, it will be necessary to
show it on a Map 14. Please provide an explanation of how vehicles will
cross ditch D34B, update applicable maps if a culvert will be used, and
provide appropriate sizing information.
NECC: Culvert C52 will be reinstalled as a 36" CMP, per Table 21. Culvert C52
is shown on a newly digitized Map -14. Map -14 was digitized for this revision. A
revised bond estimate (Exhibit 28) is attached to account for Culvert C52.
2. DRMS: On revised page 2.05 -7c, the text describes, "two light use roads and
a maintenance road." The Division does not have a definition of "maintenance
road." Please assure that all roads meet the definition and designs of 4.03.
Please revise the appropriate text to eliminate the name of "maintenance road."
Based upon the location and design of the roads, this third road (zig -zag
road) would likely fit the definition of light use road.
