L.G. EVERIST, INC.
ROCK SOLID SINCE 1876
February 14, 2012
Mr. Eric Scott
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
1313 Sherman St., Room 215
Denver, Colorado 80203
RE: Retractio o f Surety Reduction Request for Completed Reclamation in Hill- Oakley and Fort
Lupton East Phases of the Fort Lupton Sand & Gravel, M-1999-120
Dear Eric:
L.G. Everist hereby retracts its request for a Surety Reduction related to the completed reclamation work
in the Hill - Oakley and Fort Lupton East phases of the Fort Lupton Sand and Gravel Mine, # M- 1999 -120.
L.G. Everist will be submitting an amendment to this permit within the next month, and we realize there
will be bond adjustments related to all the changes put forth in the amendment application. So, rather
than doing any bond adjustments at this time, L.G. Everist would like to hold off and do all bond
adjustments after they have been determined for any changes related to the amendment.
L.G. Everist would appreciate an acknowledgement from you noting (and approving, hopefully) that your
recent inspection confirmed that a substantial amount of the reclamation (slurry walls, backfilling, sloping,
grading) has been completed in the Hill - Oakley and Fort Lupton East phases.
If you have any questions, please contact me at 303 - 286 -2247 or Imshults ©Igeverist.com.
Sincerely,
Lynn Mayer Shults
Regulatory Manager
FL- DRMS- SuretyRedRetraction- HillOakley &FLEast- 021412.doc
RECEIVED
4,_3 2O12
„Division of Reclamation,
Mining & Safety
cc: L.G.
