February 10, 2012 <br />Bureau of Land Management <br />Uncompahgre Field Office <br />Mr. Rob Ernst <br />2505 South Townsend Ave. <br />Montrose, Colorado 81401 <br />Mr. Ernst: <br />ENERGY FUELS RESOURCES <br />CORPORATION <br />Re: CO -150, 3809.301, COC- 70978- Waiver Request to Big Game winter restriction <br />On December 1, 2011 your office received a modification from Energy Fuels Resources <br />Corporation (EFR) to Colorado DRMS prospecting NOI- P- 2008 -018 for the Farmer Girl <br />project on Martin Mesa. The BLM number for the original permit is CO -150, 3809.301, <br />COC- 70978. The modification is for 16 additional holes. The proposed drill hole <br />program for the winter of 2011 is to be in the immediate area and as offset holes to the <br />several holes drilled previously by EFR on Martin Mesa. <br />BLM informed EFR that the BLM has a Big Game winter timing restriction- no activity <br />allowed December 1 through April 30- for this area. You also indicated that EFR could <br />request a waiver to the restriction. Please consider this letter that request. <br />EFR filed personnel visited the project area several times in December and January <br />following local snow storms to look for evidence of use by big game animals (Dec. 19, <br />28, and Jan. 3). Very little evidence of animal activity was noted. EFR in -house memos <br />on these inspections are attached. EFR contracted with a consulting biologist familiar <br />with the area, Craig Grother of Norwood, Colorado, to perform an independent <br />assessment of the big game winter use of the project portion of Martin Mesa. Mr. Grother <br />also consulted with the Colorado Division of Wildlife before drawing his conclusions. <br />Mr. Grother's report of work done in late January is also attached. <br />
