At this <br />time your existing permit is still considered "active" by the Division and you still have an $8,000 cash bond posted <br />for the revegetation of the site for final release. In light of the fine reclamation work that you completed prior to the <br />foreclosure, I would suggest to you that as soon as possible this spring (late April, May) you should request a full <br />release for this site. Considering the current circumstances, if the vegetation is beginning to establish at that time, <br />the Division would likely release the site and return the $8000 cash bond to you. <br />However, the 2011 annual fee for this permit of $791 is currently outstanding at this time, and the new annual fee <br />will be due in April of 2012. If your permit is revoked for failure to pay annual fees before it can be released, the <br />$8000 bond will be seized by the State and it will become very unlikely that you will be able to get it back. I'm <br />afraid the revocation process may begin soon if your annual fees remain unpaid for very much longer. <br />Another option for you would be to transfer the existing permit to the new owner of the property. The new <br />permittee would need to be willing to take over, and post the $8000 bond until the site is released. All outstanding <br />annual fees would also need to be paid before any permit transfer could be approved. I will leave it to you to <br />determine if this is a viable option for you. <br />Please call me at your convenience at (303) 866 -3567 x8140 so we can determine the best way to close this permit <br />for everyone involved.
