Pineda <br />Director <br />Re: Lorencito Canyon Mine, C1996 -084, Fourth Quarter 2011 Sediment Pond Inspection Reports <br />The Division received New Elk Coal Company's 2011 Fouth Quarter Sediment Pond Inspection <br />Reports for the Lorencito Canyon Mine on February 8, 2012. The reports state that Pond on <br />September 29, 2012. Please correct these reports to reflect the actual date of the inspections. <br />Ponds 5, 6, 7, 8, 9, and 9A were inspected. All the reports identify the adequacy of vegetative <br />cover on the pond embankments as moderate to "few ", with "few" gullies forming on the <br />embankments. No concerns were identified in the sediment pond inspection reports. <br />Annual Certification for sediment ponds was conducted in December 2011 according to the <br />reports, and will be submitted as a separate report. <br />Other than correcting the actual sediment pond inspection date, the Divison has no concern with <br />the reports, and finds these reports meet the requirement of Rule 4.05.9(17). <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
