( "Applicant ") in accordance with Section §37 -90- 137(11), C.R.S. The most recent SWSP approval letter was dated January 19, 2006. The Applicant shall be responsible for compliance with this plan. The required fee of $257 for the substitute water supply plan has been submitted (receipt no. 3622839). This plan seeks to replace depletions resulting from mining at the Nelson Mining Resources Gravel Pit ( "Nelson Pit "). Mining began in July 2006 however, due to the lack of demand for sand and gravel, the mining operation temporarily ceased and the dewatering pumps were shut down in June 2009. The mine area was allowed to fill with ground water. This site has been put into Temporary Cessation with the Division of Reclamation, Mining, and Safety effective from 8/16/2011 through 2/1/2014. Therefore this SWSP will account for the evaporation losses from the exposed ground water in the partially mined site. It is anticipated that the mining operation will resume production once there is again a demand for sand and gravel on the local market. In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the protection of water resources. The April 30, 2010 letter from DRMS requires that you provide information to DRMS to demonstrate you can replace long term injurious stream depletions that result from mining related exposure of ground water.
