( "Applicant ") in accordance with Section §37 -90- 137(11), C.R.S. The <br />most recent SWSP approval letter was dated January 19, 2006. The Applicant shall be <br />responsible for compliance with this plan. The required fee of $257 for the substitute water supply <br />plan has been submitted (receipt no. 3622839). <br />This plan seeks to replace depletions resulting from mining at the Nelson Mining <br />Resources Gravel Pit ( "Nelson Pit "). Mining began in July 2006 however, due to the lack of <br />demand for sand and gravel, the mining operation temporarily ceased and the dewatering <br />pumps were shut down in June 2009. The mine area was allowed to fill with ground water. This <br />site has been put into Temporary Cessation with the Division of Reclamation, Mining, and <br />Safety effective from 8/16/2011 through 2/1/2014. Therefore this SWSP will account for the <br />evaporation losses from the exposed ground water in the partially mined site. It is anticipated <br />that the mining operation will resume production once there is again a demand for sand and <br />gravel on the local market. <br />In accordance with the letter dated April 30, 2010 (copy attached) from the <br />Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel <br />mining operators must comply with the requirements of the Colorado Reclamation Act <br />and the Mineral Rules and Regulations for the protection of water resources. The April <br />30, 2010 letter from DRMS requires that you provide information to DRMS to demonstrate <br />you can replace long term injurious stream depletions that result from mining related <br />exposure of ground water. <br />
