This report documents observations concerning compliance with the terms of the permit <br />and applicable rules and regulations of the Mined Land Reclamation Board. <br />The following inspection topics were i ratified as having Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Reclamation Success <br />PROBLEM /POSSIBLE VIOLATION: Problem: Review of annual reports dating back to 2005 indicate no mining <br />activity since at least that time. These same reports indicate reclamation activities have been ongoing since at <br />least 2005. C.R.S. 34- 32.5- 116(4)(q)(I) states "... final reclamation of each mining phase shall be completed prior <br />to the expiration of five years after the date the operator advises the board in an annual report that such phase <br />of mining has been completed ..." <br />CORRECTIVE ACTIONS: Provide the Division with a letter stating final reclamation has begun or request the site <br />go into Temporary Cessation.
