OBSERVATIONS <br />PERMIT #: M- 1987 -023 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: February 1, 2012 <br />1) The Division conducted a monitoring inspection of the site on 2/1/12. Present during the inspection <br />was Mr. Ricky Michele the operator. <br />2) The site is a 9.9 acre permit adjacent to M- 1990 -131 also operated by Mr. Mitchell. As noted during the <br />last inspection the site is being reclaimed. The operator is authorized to use inert imported material to <br />backfill the pit. During this inspection the Division observed stockpiles of bentonite, and old recycled <br />road base with in the pit . The operator is in compliance with the requirements of Rule 3.1.5(9). He is <br />allowed to accept inert fill to backfill the pits. Even though Rule 3.1.3 requires each phase of <br />reclamation to be completed within five years from the date the operator informs the Office that such <br />phase has commenced, because of the lack of adequate inert fill to complete the reclamation, the <br />Division will consider granting additional time to complete the reclamation. However, the operator will <br />need to submit in writing requesting the extension. <br />3) The post mining land use for the site is commercial /Industrial. The current financial warranty in the <br />amount of $10,950.00 is deemed adequate to cover the cost of reclamation. <br />Page 2 of 4 <br />
