Documentation: The well has an absolute water right issued to SCC (96CW18, approved 07/06/96). The decree is <br />included in Attachment 16-1 of the PAP. <br />Powerline and Su?ons t 'on <br />Rationale: Convers with Yampa Valley Electric Association (YVEA) indicate that the powerline and substation <br />will remain inplace to supply power for the SCC shop facility and for future growth and development in the area. <br />----------------------- - <br />Justification: A letter from YVEA verifying ownership and control along with landowner letters requesting <br />retention of the powerlines and associated electrical structures are contained in Appendix 20-2.1 of this attachment. <br />Documentation: There is an electrical substation and approximately 13,340 feet of powerline within the II-W <br />permit area. This facility was constructed to provide electricity to the shop/office facility and mining equipment <br />used at the II-W Mine during mining and is owned by Yampa Valley Electric Association (YVEA), the entity that <br />provides power to the area. ` ?Ih e-s <br />Fenced Shrub <br />Rationale: ?h existing enclosures will remain inplace to ensure protection for aspens and other shrubs/trees from <br />foraging by elk, deer, and livestock. <br />Justification: The enclosures were originally required by permit to ensure that shrub/tree density was achieved for <br />bond release. Now that the time and expense has been expended, SCC and the landowners would like the <br />enclosures to remain inplace so that the shrub stands are not decimated by wildlife and livestock grazing. The <br />landowner request letters are contained in Appendix 20-2.1 of this attachment. <br />Documentation: There are ten (10) shrub plots enclosed with elk proof fencing. These enclosures vary in size from <br />1.2 acres to 5.6 acres. Exhibit 20-2, Post Mining Topography, shows the locations of these shrub plots. <br />Sedime onds <br />Ration e: The II-W permit area contains seven (7) sediment ponds that SCC proposes to remain permanent. <br />These ponds will enhance the approved postmining land use and value of the properties. <br />Justification: The pond locations, which include Ponds 005, 006, 009, 015, 016, 016A and 017, are shown on <br />Exhibit 20-2, Post Mining Topography and Drainage. These impoundments will support the post mining land use <br />of rangeland, livestock grazing, and wildlife habitat. <br />Documentation: Under applicable provisions of Rule 4.05.9(13), the permanent ponds must meet the following <br />criteria: <br />(a) The quality of the impounded water shall be suitable on a permanent basis for its intended use, shall meet <br />applicable state and federal water quality standards and discharge of water from the impoundment shall <br />meet applicable State and Federal effluent limitations and shall not degrade the quality of receiving water <br />below applicable stream standards; <br />(b) The level of water shall be sufficiently stable, and the configuration of the pond shall be adequate, to <br />support the intended use; <br />(c) Adequate safety and access to impounded water shall be provided for proposed water users; <br />(d) Water impoundments shall not result in the diminution of the quality or quantity of water available to water <br />right holders for agricultural, industrial, recreational, or domestic uses except in accordance with applicable <br />state law; <br />(e) The size of the impoundment shall be adequate for its intended purposes; <br />(f) The impoundment shall be suitable for the approved post-training land use. <br />TR-62 20-2.4 03/09
