INTRODUCTION
SCC will apply for release of the reclamation bond held by the Colorado Division of Reclamation, Mining and Safety
(CDRMS). Per the guideline pursuant to Rule 1.15.4, Guideline Regarding Selected Coal Mine Bond Release
Issues,(CDMG, 1995), states.... 'When Phase I bond releare a requested, the release will apply only to those area where hackfilliag
andgrading are completed Backfilling andgrw ing are considered completed upon the achievement offinalpost--mine topograpby in
accordana with the permit, including establishment of the approved permanent drainage rystam Amos which do nut qualm Jbr band
release include long-term faciktus such as sediment pondr, buildings, madr and other areas which will receive continued lire in acavrdancr
with the approved plan. "
SCC proposes to leave various structures as permanent features within the reclaimed area at the time of bond
release. These proposed structures are located on Exhibit 20-2, Post Mine Topography and Drainage. The
retention of the structures has been requested by the current landowners. The landowner request letters are
contained in Appendix 20-2.1, Surface Owner Request to Retain Permanent Features and Structures. The retention
of these structures will enhance the current postmine land use and landowner land use in the future.
The following discussions present the rationale, justification and/or documentation for retention of these features.
In some instances, the structure has already been approved as a permanent feature; in other cases approvals are still
required. In all cases, SCC has or will submit the required information for approval prior to applying for bond
release of an area containing a proposed permanent structure.
PERMANENT FEATURES/STRUCTURES
The structures proposed to be left as permanent features include the following.
• Access roads
• • Light use roads
• Shop and Storage Area
• Water well
• Power line and substation
• Fenced shrub plots
• Sediment ponds
• Stock ponds
• Miscellaneous boundary and grazing fences
Rationale, justification, and documentation are provided in the following discussions to demonstrate compliance
with the approved reclamation and land use plan.
Access Roads
Landowner Access Road- (load G, BidgehneA=u Roai4 Road), CongA*r Bond and Band K)
Rationale: This road will provide landowner access to individual properties within and adjacent to the II-W
reclamation area following final bond release. SCC will use this road in the interim as access for maintenance and
monitoring.
justification: Without this road some individual properties would be "land-locked" with no readily available access.
Landowner request letters are contained in Appendix 20-2.1 of this attachment A recorded right-of-way agreement
between applicable landowners is contained in Tab 3, Appendix 3-4, Right-of-Way Information.
Documentation: This road is approximately 5.7 miles in length (30,100 feet). The edges of the owl roods have
• been regraded, ripped, topsoiled and seeded to create the new average 20 foot wide limited access road The
originally constructed road ditches and culverts are left inplace and supplemental culverts have been installed to
TR-62 20-2.1 01/09
