2. The applicant should be aware that Rule 3.1.6 (1) of the Construction Material <br />Rules and Regulations require that disturbances to the prevailing hydrologic <br />balance of the affected land and to the surrounding area and to the quantity and <br />quality of water in surface and groundwater systems both during and after the <br />mining operation and during reclamation shall be minimized. In that the <br />proposed operation includes dewatering of the pits, the potential for impacts to <br />groundwater exists. Please indicate how the hydrologic balance of groundwater <br />in and around the permit site will be monitored. <br />A monitoring and mitigation plan is attached to this letter. <br />3. Please clarify where water from the mine will be discharged and provide a signed <br />affidavit that the operator has consent to discharge water into the proposed water <br />conveying structure. <br />As shown on Exhibit C -2, the dewatering discharge point is in the extreme <br />northwest corner of the permit area. The discharge will enter the Larkin tailwater <br />ditch and flow to the Colorado River. Concerning the Larkin ditch, we believe the <br />ditch has been abandoned. As we informed the Division previously, we can not <br />find the Larkin Ditch Co. The landowners can not remember any use of the ditch <br />(they previously operated a campground on the property). <br />The landowner, Laurent and BJ Jacquelin, own all the land from the permit area <br />to the Colorado River. Therefore they own the land over which the ditch flows. <br />4. Per Rule 6.4.4(f) (ii), please identify the nature of the stratum that lies <br />immediately beneath the deposit to be mined. It is stated that the underlying <br />stratum is shale bedrock. Please specify the type of shale that exists beneath <br />the proposed operation. <br />The sand and gravel deposit is underlain by the Tertiary Aged Atwell Gulch <br />Member of the Wasatch Formation. The upper part of this formation is composed <br />predominately of yellowish -gray, yellowish- brown, and black mudstone or <br />claystone and commonly contains carbonaceous shale or mudstone and some <br />coal locally. <br />5. Please supply the Division a copy of the well permit or well permit number of the <br />well permit obtained for the proposed mining operation. <br />Oldcastle is in the process of applying for a gravel pit well permit. A copy of the <br />permit will be forwarded to the Division when it is approved. Ground water will <br />not be exposed until the gravel pit well permit and the substitute water supply <br />plan (SWSP) have been approved. Wright Water Engineers is working on the <br />SWSP which includes the purchase of augmentation water from West Divide <br />Water Conservation District. <br />6. Regarding topsoil replacement, the reclamation plan states that only 4 inches of <br />topsoil will be provided as a plant growth medium. Per Rule 6.4.5(1), <br />
