The required fee of $257.00
for the renewal of this substitute water supply plan has been submitted (receipt no. 3653235). The
original plan was approved on May 21, 2001 and was most recently approved on April 21, 2011
for operations through December 31, 2011.
Plan Operation
This plan seeks to replace depletions resulting from mining operations at the Shores
gravel pit for 2012. The site contains four slurry walled areas, designated cells A through D, as
shown on the attached Figure 1. Together these four cells are planned to eventually be
connected via pipelines, by others, and become Shores Lake (WDID 0503900) as adjudicated
in 00CW0083. Cells A, B and C were initially dewatered and dry mined. A slurry wall was
constructed around cells A and B and lining for these cells was approved in January 2007. A
slurry wall was also constructed around cell C and was approved in December 2009. A slurry
wall was constructed around cell D but has not yet been tested or approved. During the period
of this plan mining will only occur in cell D. The depletions that result from mining operations at
the Shores pit are evaporation, water lost in mined product, concrete batching, dust suppression
and dewatering. The proposed replacement sources are 0.5 shares of the Rural Ditch and a
lease with the City of Longmont. These accretions are applied to this plan against the
evaporation and operational depletions at the site.
In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado
Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators
must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules and
Regulations for the protection of water resources. The April 30, 2010 letter from DRMS requires
that you provide information to DRMS to demonstrate you can replace long term injurious
