have been made to manganese comparison paragraph. Changes have been
made to iron comparison paragraph, see page 2.05 -59.
15. DRMS: Please incorporate the January 12, 2012 correction letter from
the Office of Surface Mining into the PAP and ensure that all
correspondence and documentation pertaining to the BA and BO have
been incorporated into Exhibit 19.
CAM: Please insert OSM correction letter number two into Exhibit 19.
16. DRMS: In Section 3.02 of the original submittal CAM prepared a cost
estimate. This estimate is low compared to the liability calculated by the Division.
The Fruita Loadout bond liability is estimated to be $1,128,070.00 (sent
previously under separate cover). This does not include water disposal costs
which are necessary, since the ponds cannot discharge and we assume they
would be full in the unlikely event that bond is forfeited. Attached is the RAW cost
for hauling and disposing of the pond water. The estimate is for 1.86 acre -feet of
water (pond 1 = 1.27 af, pond 2 = 0.37 and pond 3 = 0.22 at), which is 600,000
gallons of water when full. The direct cost is $734,098.00 (which is about
$925,000.00 with indirect costs). The total estimated liability including water
disposal is $2,053,070.00. CAM will need to incorporate our estimate into the
PAP or prepare a revised cost estimate for Division review. If CAM agrees with
our original cost estimate plus the water disposal cost, we can finalize the
estimate and send it to you for pagination and incorporation into the PAP.
CAM: Please see revised Section 3.02.
Please feel free to call me if you have any questions.
Sincerely,
Tamme Bishop
Project Engineer
Enclosures:
Volume I:
Volume II:
Sections 2.04 -11, 2.05 -3, 2.05 -6. 2.05.6(6) and 3.02
Exhibit 19 (OSM correction letter #2), Exhibit 20 (new)
Map -13
Cc:
DRMS - Mike Boulay, Denver office - 2 copies
Edge Environmental
Rhino Energy
