PERMIT #: M -1985 -112 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: January 20, 2012 <br />Signs and Markers: <br />An entrance sign was observed as required by Rule 3.1.12. The permit boundary was defined by fencing on all <br />sides of the site. The boundary was not verified by the Division during the inspection. <br />Topsoil: <br />The Division conducted an inspection of the mine on October 3, 2007 to investigate a citizen complaint for <br />exporting and selling topsoil from the site. The approved reclamation plan states 34,500 cubic yards of topsoil <br />will be stripped during the life of the mine and 9,690 cubic yards of overburden from Mining Area 11 will be <br />used to grade the south slope at 5H:1V. During the 2007 inspection, a number of large topsoil stockpiles were <br />noted in the northwest corner and along the southeastern border of the site. <br />Evidence of topsoil stripping in advance of mining was observed north of the processing plant. However, the <br />previously observed stockpile in the southeast of the site was not observed and the northwest corner of the <br />site had been recently disturbed and the previously identified stockpile was not observed. The approved <br />stockpile locations for the mine are along the west, north and east boundaries north of the 100 -year flood <br />zone. <br />To avoid a possible violation, the Operator must document there is enough available topsoil material to re- <br />topsoil the site to 6 to 12 inches in the flood buffer zone, 18 to 24 inches above the flood zone and enough <br />overburden to re -grade the south slope. If the topsoil is not available on site, the topsoil will need to be <br />imported by the Operator to complete the required reclamation at the site. The reclamation bond will need <br />to be increase to account for the importation of topsoil if insufficient topsoil is available on -site. <br />Reclamation Success: <br />Noxious weeds were observed during the inspection within the permit area. If not controlled, the noxious <br />weeds will hinder and /or delay successful reclamation of the site and contribute to off-site spreading and <br />establishment of these weeds. A weed control plan has not been submitted for the site. Mr. Loloff stated he <br />was aware of the requirement for a weed control plan and would submit one in the future. The Division <br />recommends the Permittee consult with the local weed control agency in Weld County for assistance in <br />developing a plan prior to submitting the plan as a technical revision to this permit. <br />Inspection Contact Address <br />Mr. Don Loloff <br />Loloff Construction, Inc. <br />P.O.
