Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta E.Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (Division) received Nuvemco's response of <br />deficiencies for the above referenced Notice of Intent (NOI) On January 9, 2012. The Division notes that <br />along with addressing the deficiencies noted in the December 14, 2011 review Nuvemco is requesting an <br />amendment to the application to include the opening of three adits for investigation purposes. Since <br />the inclusion of the adits constituted an amendment the required public comment period of 10 working <br />days must be reapplied. The Division posted the document to the web on January 11, 2012 so the final <br />date for comment was January 25, 2012. Staff waited the additional 10 working days to see if any <br />comments were submitted regarding the addition before responding to the submittal. None were <br />received. <br />The Division has reviewed the NOl application deficiency response of January 9, 2012 and notes some <br />additional deficiencies that must be addressed prior to a decision. Please address the following: <br />1. Staff cannot locate on the newly supplies map the location of the adits to be opened. Please <br />clarify the exact location of the adits on the map and including the legal description. <br />2. What, if any, access improvements will be required to get equipment to the adits? Please note <br />this may affect the current reclamation liability estimate noted below. <br />3. The Division is including the reclamation liability estimate based on the clarifications and <br />submitted information regarding the adits. Because staff is unsure which way the adits will be <br />sealed or secured the estimate is for backfilling and seeding of the total disturbance at each site. <br />The required bond for the project is set at $26,735.00. The Division notes a commitment to 50 <br />holes maximum drilled at any one time and no sampling or additional work at the adits other <br />than what is specifically described. While the Division has never had any issues with Nuvemco a <br />demo cost estimate is attached to show the costs for reclamation if the commitment of 50 holes <br />is not kept. <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
