Hamilton PI. <br />Sheridan, CO 80110 <br />Re: Notice of Deficiencies <br />London Butte Underground Exploration, NOI File No. P -2011 -029 <br />Dear Mr. Miller: <br />STATE OF COLORADO <br />Item number 1 in your consultant's (Ben Langenfeld's) letter of October 24, 2011 <br />indicates that 2000 tons of material will be removed from the adit. Item 9 in the letter <br />indicates the waste material removed from the adit will be placed on a stockpile north of <br />the adit on the existing historical dumps. Item 9 also indicates the toe of the stockpile <br />will be located at least 50 feet from Mosquito Creek, and a trench roughly one foot deep <br />will be excavated surrounding the waste pile area for capturing any surface water runoff. <br />The DRMS believes the above - described measures appear adequate for protecting the <br />drainage system from pollution if the material has low acid - producing potential, but the <br />measures may be inadequate if the material has high acid - producing potential. Please <br />commit to determining the acid - producing potential of waste material extracted from the <br />adit, prior to beginning placement of the material in the stockpile. Also, please describe <br />a contingency plan for disposing the material in a manner that protects the drainage <br />system from pollution, if the material has high acid - forming potential. <br />The letter of October 24, 2011 says that a check for the financial warranty was attached, <br />but DRMS records do not show receiving such a check.
