Bill Bear of Bowie <br />Resources, LLC was present for the inspection. Weather conditions were overcast, foggy and cool. The <br />mine had 8 inches of snow, received in the previous two days. The ground conditions were muddy from <br />the melting snow making most of the mine areas inaccessible. The longwall miner was in operation and <br />coal was being stacked and loaded onto a train. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />The stacking tubes were in operation and a unit train was being loaded during the inspection. There was a <br />moderate amount of coal in the stock pile and there were not any signs of fugitive dust on site or off. <br />EXPLOSIVES — Rule 4.08 Distance Prohibitions 4.08.4, Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br />No problems with the cap and powder houses were observed. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Ponds B, C, D, F had standing water and were mostly snow covered (photo 1 & 2). These ponds were not <br />discharging and the berms appeared to be stable. Ponds J and K were covered with snow and did not appear to <br />have water. All ponds appeared to be functioning properly. <br />PROCESSING WASTE /COAL MINE WASTE PILES —Rule 4.10 and 4.11 Drainage Control; Surface <br />Stabilization; Placement: <br />The west end of waste pile 42 was being worked by a bulldozer. The area was very muddy but did not <br />have any standing water and appeared to be stable.
