Director /State Engineer Re: Bestway's Brighton Combined Substitute Water Supply Plan (WDID 0202587) Parker - Dersham Pit, DRMS Permit No. M- 2006 -003 (WDID 0203026) Baseline Resource Pit, DRMS Permit No. M- 1997 -058 (WDID 0203017) Section 36, TIN, R67W, 6 P.M., Adams County RECEIVED Water Division 1, Water District 2 5012 0 2012 Division of Reclamation, Mining & Safety Dear Mr. Rodriguez: We have received your letters of September 23, 2011 and December 26, 2011, requesting renewal of the substitute water supply plan ( "SWSP ") for the Parker - Dersham Resource Pit and the Baseline Resource Pit. The required fee of $514.00 (2 x $257) for the renewal of this SWSP has been submitted (receipt nos. 3652537 & 3652538). The original supply plan for Parker - Dersham Resource was approved on July 31, 2008 and it was most recently approved in a letter dated December 22, 2009. The original supply plan for Baseline Resource was approved on May 21, 2001 and it was most recently approved in a letter dated April 18, 2011. The two gravel pits which are the subject of this SWSP are adjacent to each other, under a common ownership, and share operational water uses and replacement supplies. Your request seeks to combine the two pits into a combined SWSP. Effectively, the SWSP for the Baseline Resource Pit will no longer be operational after December 31, 2011 and the Parker - Dersham Resource SWSP starting on January 1, 2011 fully includes the Baseline Resource Pit. For clarity, the Parker - Dersham SWSP will now be referred to as Bestway's Brighton Combined SWSP. Plan Operation This combined plan seeks to replace depletions resulting from mining operations at the Parker - Dersham Pit and the Baseline Pit. The depletions that result from mining operations during this SWSP approval period are evaporation, concrete batching, and dust suppression. The proposed replacement source is a water lease with the City of Aurora of fully consumable water, and an onsite Laramie -Fox Hills non - tributary well (Permit no. 64750 -F). The eastern portion of the Baseline Pit is encompassed by an existing slurry wall, and is known as Robert W. Walker Reservoir (WDID 0203358). The majority of the western portion of the Baseline Pit and the southern portion of the Parker - Dersham Pit is encompassed by an existing slurry wall, and is known as Kirby - Dersham Reservoir (WDID 0203386).
