OBSERVATIONS <br />PERMIT #: M- 1982 -141 <br />INSPECTOR'S INITIALS: DMC <br />INSPECTION DATE: January 4, 2012 <br />This inspection was conducted by Division of Reclamation, Mining and Safety (Division) <br />inspectors, Dustin Czapla and Steve Shuey, at the request of the Operator, in order to follow up <br />on problems noted during a November 18, 2011 inspection. Darryl and Brett Steele, <br />representing the Operator, were present during this inspection. Photographs are included at the <br />end of this report in order to illustrate some of the conditions observed during this inspection. <br />The Juniper Quarry is located approximately 3.6 miles southeast of Maybell and accessed from <br />CR57. The site is a 112c operation that includes a total of 88.7 permitted acres. <br />The current configuration of the permitted area for this site consists of two noncontiguous <br />portions. A 63 acre area was permitted through a 112c Conversion (CN1) in June, 1992. A <br />separate 25.7 acre area was added to the permitted area through an Amendment (AM1) in July, <br />2005. The area added through AM1 lies approximately 0.25 miles to the southwest of the <br />original 63 acre permit area. <br />The Division currently holds a financial warranty amount of $95,276.00 for this site. This <br />amount was determined to be inadequate following the Division's November 18, 2011 <br />inspection. A Surety Increase (SI -1) notice was sent to the Operator on November 29, 2011. <br />Adequate mine identification signage was noted at the entrance to the site in accordance with <br />Rule 3.1.12(1). <br />The affected area was not adequately marked by monuments or other markers that were clearly <br />visible and adequate to delineate the affected area boundary in accordance with Rule 3.1.12(2). <br />A primary objective of this inspection was to determine if there was adequate area within the <br />permit boundary to allow for reclamation of the highwall through a cut and fill method. Since <br />the permit boundary along the east portion of the CN1 area was not clearly marked, this <br />determination was not possible during this inspection. (Note: Following this inspection and prior <br />to issuance of this inspection report, the Operator installed boundary markers in order to resolve <br />this issue. It appears that there is adequate area within the permit boundary to allow for <br />reclamation of the highwall through a cut and fill method.) <br />CN1 AREA <br />■ The fuel and equipment storage area located south of the active pit had been cleaned up. <br />Contaminated soils appeared to have been removed from this area. Trash and refuse was <br />placed into one centralized location. <br />► The 10,000 gallon diesel tank still lacked any secondary containment. The Operator stated <br />that the fuel tank was empty and did not believe that it had been used for several years. An <br />equipment operator was observed fueling a loader from this tank during the Division's last <br />inspection. <br />■ The area around the containment structure next to the 10k diesel tank had been cleaned up. <br />The 55 gallon drums of hydraulic oils and engine oil had been placed inside this structure. <br />The plug for the structure had been replaced. <br />Page 3 of 5 <br />
