ANNUAL REPORT AFFIDAVIT RE: MINING ACTIVITIES <br />RE: PERMIT NO. M - 1995 -097 <br />County of Pitkin ) <br />) ss <br />State of Colorado ) <br />The undersigned, after being first duly sworn and under oath, states and affirms: <br />1. I am a shareholder in New Smuggler Mine Corporation the owner of the <br />Smuggler Mine and the beneficial holder of the above referenced permit. <br />2. Based on my actual knowledge, I represent that no activities have taken <br />place that have or would have any affect on the bond requirements for the Smuggler <br />Mine. <br />3. All activities have taken place underground or involved portal repairs for <br />safety issues. Other activities have been limited to some minor exploration, remediation, <br />and commercial historic mine tours. <br />4. The bond is a Certificate of Deposit assigned to the Division of Minerals <br />and Geology, is in full force and effect, and continues to be sufficient security for the <br />above referenced permit. <br />5. Further the affiant sayeth naught. <br />The foregoing Annual Report Affidavit Re: Mining Activities was duly executed <br />and subscribed to before me on this /3V day of January 2012, by Gary A.
