Pineda <br />Director <br />Re: Fruita Loadout (Permit No. C- 2010 -088) <br />New Permit Application Review, Incorporation of United States Fish & Wildlife <br />(USFWS) Conservation Measures <br />Dear Mr. Heaps: <br />The Division of Reclamation, Mining and Safety (Division) has reviewed CAM Colorado, LLC's <br />(CAM's) response to our November 21, 2011 request for incorporation of the United States Fish <br />& Wildlife Service Biological Opinion conservation measures into the permit application <br />package (PAP). On Decemberl4, 2011 CAM submitted revised permit sections, maps, and <br />Exhibits to incorporate the conservation measures into the PAP. The Division has the following <br />comments regarding the new and revised application materials. <br />1. On page 2.04 -26 the acronym for United States Fish and Wildlife Service (USFWS) is first <br />given. However, throughout much of the remainder of the text the acronym (FWS) is used. <br />Please use USFWS throughout the PAP for consistency. <br />2. Please add the following reference to Item 3 on revised page 2.04 -36. "The BA, the BO and <br />other related correspondence have been incorporated into Exhibit 19." <br />3. Please add the following discussion to permit text at the top of revised page 2.04 -37 prior to <br />the USFWS conservation measures discussion. "The BA was prepared to evaluate effects of <br />the Proposed Action - construction and operation of the McClane Canyon Mine Expansion <br />and Federal Lease Modification and construction and operation of the Fruita Loadout Facility <br />- in sufficient detail to determine effects on federally listed endangered and threatened <br />species and designated critical habitat. Because of the potential effects to fish and critical <br />habitat, conservation measures have been specified in the Biological Assessment that will <br />avoid /or minimize adverse effects. Seven conservation measures are specified pertaining to <br />both the McClane Canyon Mine Expansion and the Fruita Loadout Facility. The <br />conservation measures are listed in the BA contained in Exhibit 19. Five of the conservation <br />measures, Items 3 through 7 are specific to the Fruita Loadout project and these are listed <br />below."
