(a)(ii) Volume II, Map 23, Water Rights Location shows the water rights within the <br />permit and adjacent area. Water right map codes 1, 2, 3, 4, 5, 11, 14, 15 & <br />32 are within the area that could be affected by mining. Map codes 1 <br />through 5 are decreed water rights described as J & M Spring & PL No. 1 - 5. <br />Map code 11 is the Leonard Springs. Map code 32 is the Bowie Spring No. <br />3. The Operator owns water right map codesl , 2, 3, 4, 5, 11,14 & 32. Map <br />codes 14 and 15 are Bowie Springs 17 and 13 respectively. <br />(a)(iii) The narrative in Section 2.04.7(3) discusses the impact the mining operation <br />could have on the quantity of surface and ground water within the permit and <br />adjacent area. This impact is restricted to potential depletion of water from <br />the springs and ponds and surface streams. Limited extraction will be <br />utilized to protect Pond #1. The other ponds are either not within the <br />projected angle of draw or in an area where there is sufficient overburden to <br />minimize the risk of subsidence induced damage. No measures are <br />proposed to protect the springs because the likelihood of damage to the <br />springs by the mine operation is considered minuscule. <br />MR -128 <br />The quantity of water in the springs and seeps could be reduced by <br />subsidence cracks. Subsidence cracks could intercept the impervious layer <br />below the springs and seeps which would cause them to drain to the <br />formation below. <br />Map codes 7, 8 and 12 are located along Hubbard Creek beyond the <br />projected angle of draw. Decreed water right No. 6 is located outside the <br />permit boundary and will not be affected by mining. Water right no 13, Reds <br />spring and pipeline, is within the permit boundary but outside of the area <br />affected by mining. The water rights along old State Highway 133 should not <br />be adversely effected by the mining operation because these water rights are <br />in a formation that is geologically at least 800 feet below the mine workings. <br />The J & M Springs & Pipelines are claimed for domestic and stock watering <br />purposes. Water right numbers 1 and 3 are decreed for 4 gallons per minute. <br />Number 2 is decreed for 2 gpm. Numbers 4 and 5 are decreed for 5 gpm. <br />Leonard Springs Nos. 1 & 2 are decreed for 22.4 gpm <br />2.05 - 102 01/13/12 <br />
