MANAGEMENT <br />January 4, 2012 <br />Janet Binns <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Re: New Elk Mine Permit C- 1981 -012 <br />Technical Revision Application No. 62, NOV CV- 2011 -008 <br />Cell Repeater Installation <br />Dear Ms. Binns <br />By letter dated December 13, 2011, New Elk Coal Company, (NECC) submitted an application for a <br />minor revision to construct a cell repeater on a point high above the mine facilities. By letter December <br />23, 2011 the DRMS advised NECC that the cell repeater installation had to be processed as a technical <br />revision because it included road construction. On behalf of NECC, please withdraw MR -103 from further <br />consideration. There are two drawings submitted with MR -103 (Map 11 Sheets 1 and 2) that will be used <br />to support this technical revision application. The technical revision application addresses items 4, 5 & 6 <br />in NOV CV- 2011 -008. <br />The cell repeater will be installed on a point east of the refuse disposal area. Associated facilities include <br />constructing a power line to the cell repeater and constructing necessary travel ways. The cell repeater is <br />mounted on a long power pole. A light use road to access slurry wells S2 and S3 is also included in this <br />revision. This light use road is about 1,220 feet long and disturbs approximately 0.3 acres. <br />The roads necessary to the access the cell repeater will be designated a light use road and a maintenance <br />road as shown on Map 11, Sheet 1. The light use road is located along a previously disturbed area. The <br />maintenance road will be utilized to construct the power line. Approximately 0.5 acres of new disturbance <br />will occur during the construction of the maintenance road. The power line is shown on Map 11, Sheet 2. <br />The affected area will not increase since this area has been undermined. <br />The light use road and maintenance road both cross the RDA upper diversion ditch. Enclosed are <br />calculations for sizing two 42 inch diameter culverts to be installed in the RDA upper diversion ditch <br />(Exhibit 19(19)). The light use road to the slurry wells crosses a diversion ditch. Exhibit 14 shows there is <br />a culvert designed for this crossing. The culvert is designated C53 and is 21 inches in diameter. <br />Documents provided to support this technical revision are listed below. <br />Sincerely, <br />J. E.
