We wanted to wait until we held the meeting with the Vento
group. I will research the additional questions that were brought up at the meeting or on Friday 1/6 that I had inadequate
time to research. I have been in the field since Tuesday morning, so I have not been able to follow up on this. I will not be
back in the office until tomorrow.
I am extremely confused about your question regarding the January board hearing. The Division has not made a
proposed decision on TR39. Once we make a proposed decision, then you may request a board hearing if you disagree
with the Division's proposed decision. If you request a hearing, in writing, not via e-mail, then DRMS would schedule this
for the next board meeting.
Our rules and regulations are all available on the website, that provide detail of how you may request an item to be heard
by the board.
I would have to research how many revisions have been requested for changes to reference areas in the last 20 years.
We had 64 permitted coal mines in the state at one time, so there is quite a large data base. I know of one off the top of
my head due to the landowner mowing all the oak brush in the reference area in year 10 of the operator's period of
liability.
Please explain the hardship the current rules incur due to reclamation area needing to have a minimum 10 year liability
period? The 10 year liability period has been in place since our Rules were promulgated in 1981 and follow the liability
period required by SMRCA.
Janet Binns
From: Linda Saunders fmailto:saunders615 @live.com]
Sent: Wed 1/11/2012 3:51 PM
To: Binns, Janet
Subject: Hearing shedule
Hi Janet,
Thank you for researching and having the information ready for our meeting. I was really impressed and appreciative.
When will you make a decision and how will we find out.
Also, I tried the phone number for Irene and only got a voice message. I did leave a message.
What day and time will revegetation be discussed during the hearings on Jan 11 -12.
1
