MANAGEMENT <br />New Elk Coal Company's, (NECC) approved Blue Seam mine plan has one set of mains to be <br />developed to the south that are located on the east edge of the permit boundary. NECC would <br />like to add an additional set of south mains to the mine plan. The additional set of south mains <br />will facilitate increased production, better ventilation and provide the opportunity to develop <br />panels to the east off of the second set of south mains NECC is only requesting approval to <br />develop the second set of south mains at this time. On behalf of NECC, enclosed is a application <br />for an incidental permit boundary revision to provide the necessary room to the east to mine a <br />second set of south mains <br />All coal seams within the incidental permit boundary revision are leased from the State of <br />Colorado acting through an by the Department of Natural Resources for the use and benefit of the <br />Division of Wildlife. A copy of NECC's lease documenting right of entry is included in Exhibit <br />34- Adendum Division of Wildlife Lease. <br />The incidental permit boundary revision is approximately two miles long and 550 feet wide and <br />encompasses 144.2 acres. This is an increase of 3.4% over the approved 4,198.9 permit <br />boundary. This is a good time to reconcile the permit acreage. Apparently the 10.5 acre permit <br />boundary at the Jansen Yard was dropped from the permitted acres. Additionally the approved <br />4,198.9 acre permit boundary is 2.6 acres less than is determined from the ACAD drawings. The <br />corrected permit boundary acreage is shown in the table below: <br />
