Pineda <br />Director <br />The Division of Reclamation Mining and Safety (Division) has received a copy of <br />correspondence from the Applicant Violator System (AVS) Office to GCC Energy, LLC, <br />operator of the King Coal Mine (Colorado permit No. C- 1981 -035). The letter indicates that <br />GCC Energy, LLC will need to update its ownership and control information in compliance <br />with 30 CFR 774.12(c) and the "coordinating Colorado statute ". The currently approved <br />Rules and Regulations of the Colorado Mined Land Reclamation Board (Rules) do not <br />include provisions that correspond to 30 CFR 774.12(c). The Division has submitted a formal <br />program amendment to the Office of Surface Mining (Denver Field Division) that will include <br />a corresponding rule, but the amendment is currently under review and therefore not yet <br />effective. Accordingly, the Division has not yet required Colorado operators to comply with <br />this provision. It is therefore our contention that GCC Energy, LLC is in compliance with the <br />Rules pertaining to ownership and control information and need not submit additional <br />information as indicated by the AVS Office. <br />Coincidentally, the currently approved permit application for the King Coal Mine will expire <br />on August 8, 2012. As such, GCC Energy, LLC was notified by the Division on November 27, <br />2011 that an application for renewal of the King Coal Mine permit must be received by the <br />Division on or before February 20, 2012.
