December 22, 2011 C- 1981- 012/New Elk Mine JHB <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond No. 4 had been identified during the November 16, 2011 inspection as needing appropriate management. <br />The Emergency spillway had willows established in the emergency spillway. Removal of the willows from the <br />emergency spillway was Abatement Step No. 1 of NOV -CV- 2011 -006. At the time of the inspection, the willows <br />had been cut and removed from the Emergency (Secondary) spillway of Pond 4. Stumps still remain and will need <br />to be monitored in the spring to assure re- sprouting does not occur. Abatement Step No. 1 of NOV -CV- 2006 -006 <br />was completed. The operator also removed willows and other vegetation from the Pond 4 inlet of Ditch D2. Pond <br />4 was snow covered, but held no pool of water or ice. <br />Pond 1 was snow covered. Pond 7 was snow covered with a frozen pool of water. Pond 7 was not discharging at <br />the time of the inspection. Bobby stated that the gate valve was closed. NECC had been having concerns with the <br />effluent discharge from Pond 7 and was looking into changing the flocculent or contracting for filtration of Pond 7 <br />water. If treatment of the water will result in new structures, a revision will be needed to the permit. Bobby also <br />stated that clean out of Pond 7 will be a priority in 2012. NECC is evaluating lining Pond 7. Potential placement <br />of pond clean out sediment was discussed. Bobby said that pond cleaning storage area would be permitted prior to <br />implementation. <br />Ditches throughout the mine site were snow covered. Ditch D30 had been cited in NOV -CV- 2011 -006 for having <br />obstructions in the ditch. The rock, power pole and shrub had been removed from Ditch D30. Abatement Step <br />No. 2 of NOV-CV-2011-006 has been complied with. <br />Air tubing was removed from Ditch D -16 during the inspection. Ditch D -16 is unobstructed. Abatement step No. <br />3 of NOC- CV- 2011 -006 has been abated. <br />The northern culvert located west of the C& W building (north of Culvert C2) has been appropriately cleaned of <br />sediment. Abatement step No. 5 of NOV -CV -2011 -006 has been abated. <br />Culverts under the Refuse Disposal Area (RDA) access road were also cited in NOV -CV- 2011 -006 as requiring <br />sediment clean out. Culvert C40 had been replaced with steel pipe. The new pipe is clear of sediment. However, <br />this pipe is composed of two non continuous sections. An 18 inch dia. steel pipe has been installed at the inlet. <br />There is a break between the inlet and outlet sections of pipe and a bend between the pipes. The outlet pipe is a 14 <br />inch diameter pipe. This culvert arrangement will require replacement with an appropriately sized diameter and <br />length of pipe. There should be no bend or break in the pipe. <br />Culvert CB was not cleaned or replaced. Culvert CB is not impeded by sediment, but the inlet has been partially <br />crushed.
