DIVISION OF RECLAMATION, MINING AND SAFETY <br />Department of Natural Resources <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Phone: (303) 866 -3567 <br />FAX: (303) 832 -8106 <br />January 9, 2012 <br />AGC Resources, LLC <br />1580 Lincoln St, Suite 700 <br />Denver, CO 80203 <br />RE: Reason to Believe a Violation Exists at the Cash & Who Do Mines; DRMS File No. <br />M- 1983 -141 <br />To Whom it May Concern, <br />STATE OF COLORADO <br />In the Board Order dated December 8, 2011, the Mined Land Reclamation Board found AGC <br />Resources, LLC to be in violation of §34-32-116(7)(h), C.R.S., for failing to protect areas <br />outside of the affected land from slides or damages occurring during the mining operation; and in <br />violation of §34- 32- 116(7)(g), C.R.S., for failing to minimize disturbance to the prevailing <br />hydrologic balance of the affected land and the surrounding area and to the quality and quantity <br />of water in surface and groundwater systems; and in violation of Rule 3.1.6 by failing to comply <br />with applicable federal and state water quality laws and regulations, including statewide water <br />quality standards and site - specific classifications and standards adopted by the Water Quality <br />Control Commission, CDPHE; and in violation pursuant to §34 -32 -124, C.R.S. for failing to <br />comply with the conditions of an order, permit, or regulation. You were ordered to complete the <br />following corrective actions: <br />1) The Operator shall, within 30 days of the effective date of the Order, submit all past due <br />Annual Water Monitoring Reports. <br />2) The Operator shall, within 30 days of the effective date of the Order, submit either a <br />discharge permit from CDPHE or written proof that the application process for such <br />discharge permit has commenced. <br />3) The Operator shall, within 30 days of the effective date of the Order, complete permanent <br />closure of the secondary escape -way. <br />Office of <br />Mined Land Reclamation <br />COLORADO <br />D I V I S I O N O F <br />RECLAMATION <br />MINING <br />— &— <br />SAFETY <br />John W Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta E Pineda <br />Director <br />The Board imposed a civil penalty of $200 per day for 49 days of violation for a total civil <br />penalty of $9,800. The total civil penalty was to be submitted to the Division within 30 days of <br />the effective date of the Board Order. <br />The Division has not received the past due Annual Water Monitoring Reports. The Division has <br />not received evidence the Operator has obtained a discharge permit from CDPHE or written <br />Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
