For additional specific findings concerning this alluvial valley floor please see Section B, <br />XII. <br />13. The Division has approved the post- mining land uses of the operation. It was determined <br />that the primary post- mining land uses of rangeland /wildlife habitat, non - irrigated <br />cropland, and secondary industrial use meet the requirements of Rule 4.16 (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are addressed in <br />the following section, Section B (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats (2.07.6(2)(n). For additional discussion <br />please refer to Sections B, VIII (Revegetation) and X (Protection of Fish, Wildlife, and <br />Related Environmental Values). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, Seneca Coal Company, the operator is current in the payment of reclamation <br />fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />SECTION B - Rule 4 <br />I. Roads - Rule 4.03 <br />The Seneca II -W Mine utilizes three types of roads within the permit area. A number of <br />Haul roads were used to haul coal from the pit to the Hayden Station. Three access roads <br />have been permitted and constructed; the coal carrier shop road at the east end of Tie <br />Across Haul Road (TAHR), the oil well road in the "B" Pit area, and the "Ridgeline <br />Access Road", which provides access to portions of the reclaimed area. A number of <br />existing light use roads are used to gain access to monitoring facilities and reclamation <br />areas. The Tie - Across Haul Road and the coal carrier access road will be removed from <br />the permit area with final approval of this permit revision (PR06). All roads within the <br />permit boundary are depicted on Exhibits 12 -2 and 13 -2, and are discussed in Tab 13. <br />A. Haul Roads <br />Previously approved haul roads in the mine area include the Mine Entrance Haul <br />Road (MEHR), and Roads A, G, H, I, J, K, and L. In addition, approximately 4.1 <br />miles of the Tie Across Haul Road (TAHR) was constructed from the Hayden <br />Power Station to Routt County Road 53. The TAHR will be removed from the <br />permit area with approval of PR -6. Mine Area haul roads are depicted on Exhibits <br />12 -2, and 13 -2.
