Mr. Joe Kraig Page 3 of 4 <br />December 30, 2011 <br />1. This plan shall be valid for the period of September 1, 2011 through August 31, 2012, <br />unless otherwise revoked or modified. If this plan will not be made absolute by a water <br />court action by the plan's expiration date, a renewal request must be submitted to this <br />office with the statutory fee of $257 no later than June 30, 2012. <br />2. A well permit has been obtained for the current use and exposed pond surface area of <br />the gravel pit in accordance with §37 -90- 137(2) and (11), C.R.S., permit no. 62970 -F. <br />3. Well permit no. 66319 -F was approved pursuant to §37 -90- 137(2), C.R.S., for the <br />proposed operational uses. <br />4. Approval of this SWSP is for the purposes stated herein and pumping is limited to the <br />wells identified above. Additional wells and /or additional uses for the water that is the <br />subject of this SWSP will be allowed only if a new SWSP is approved for those <br />additional wells /uses and such additional wells /uses. <br />5. The total surface area of the ground water exposed must not exceed 2.0 acres, which <br />results in a maximum evaporative annual loss at the Heit Sand and Gravel Mine of 5.82 <br />acre -feet. <br />6. The annual amounts of water used at the Heit Sand and Gravel Mine shall not exceed 1.0 <br />acre -feet for dust control, and the total amount of aggregate washed shall not exceed <br />485,000 tons per year, resulting in a consumptive use of 10.7 acre -feet of water. The <br />annual amount of water used at the site for operational purposes therefore shall not exceed <br />11.7 acre -feet. <br />7. Total consumption at the Heit Sand and Gravel Mine must not exceed the <br />aforementioned amounts unless an amendment is made to this plan. <br />8. Approval of this plan is for the purposes as stated herein. This office must first approve <br />any additional uses for the water. <br />9. All releases of replacement water must be sufficient to cover all out -of- priority depletions <br />in time, place, and amount and must be made under the direction and /or the approval of <br />the water commissioner. The release of replacement water may be aggregated to <br />maximize beneficial use. The water commissioner and /or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />10. The replacement water that is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply plan, <br />the replacement water must be appurtenant to this site until a plan for augmentation is <br />obtained. A copy of this approval letter should be recorded with the County Clerk and <br />Recorder. All replacement water must be concurrent with depletions in quantity, timing, <br />and locations. <br />11. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the Applicant shall maintain daily <br />records of all diversions, replacements, and the amount of water used for each particular <br />purpose. The Applicant shall provide a report of these records to the Division Engineer <br />(DivlAccountinq(a�state.co.us) and the water commissioner (Bill Schneider at <br />William.Schneiderstate.co.us) on a monthly basis. The accounting must be submitted <br />within 30 calendar days of the end of the month for which the accounting is being made. <br />In addition, the Applicant shall verify that the entity making replacements has included <br />them on their accounting submitted to our office; for this plan, that entity is the City and <br />County of Broomfield.
