Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />RECEIVEr <br />Q4�01: <br />Division of Reclamatio; :. <br />We have received your letter dated December 9, 2011 requesting a seconiiimewttjof <br />the above referenced substitute water supply plan ( "SWSP ") to cover depletions caused by an <br />existing gravel mining operation at the Heit Sand and Gravel Mine in accordance with § 37 -90- <br />137(11), C.R.S. The amended SWSP is requested to modify the operational use of water at the <br />site and the resulting depletions and replacements. This amended SWSP shall replace, in <br />entirety, the SWSP approved for this site on August 4, 2011 and its first amendment dated <br />December 7, 2011. The required fee of $257 for this SWSP renewal has been received (receipt <br />no. 3653332). <br />The Heit Sand and Gravel Mine (WDID 0203038) was Tined in accordance with the State <br />Engineer's Lining Criteria, approved by the Division Office on June 24, 2009. Therefore, in <br />accordance with paragraph 21 of the General Guidelines for Substitute Water Supply Plans for <br />Sand and Gravel Pits, the applicant is not required to provide replacement for water removed <br />with the mined product. For purposes of this SWSP, you have conservatively assumed that <br />exposed ground water remains within the lined area. Therefore, this plan will account for <br />depletions resulting from evaporation of the exposed ground water within the Tined area. <br />Operational depletions at the site will consist of water used for dust control and for washing of <br />the mined aggregate. Total depletions for the Heit Sand and Gravel Mine during the period of <br />this SWSP will be replaced by fully consumable water leased from the City and County of <br />Broomfield. <br />In accordance with the letter dated April 30, 2010 from the Colorado Division of <br />Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply <br />with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations <br />for the protection of water resources.
