Mr. Tony Waldron, Division of Reclamation, Mining and Safety <br />December 28, 2011 <br />Page Two <br />ground water exposure. Furthermore, as AI has already mined and reclaimed the site in <br />accordance with the DRMS permit and the Lease with 83 Joint Venture, AI will be <br />seeking to transfer the permit back to 83 Joint Venture through a Succession of Operator <br />so that they may conduct any additional reclamation work necessary to achieve <br />compliance with DRMS and DWR requirements. Upon obtaining 83 Joint Ventures' <br />decision, the appropriate bond re- calculation and financial warranty will be submitted to <br />DRMS. <br />AI has already submitted its 2012 South Platte combined substitute water supply plan <br />renewal request to DWR to include coverage of all water obligations associated with the <br />reclaimed open ponds at the F Street site and will continue to maintain the site in this <br />temporary supply plan until such time as the site is covered under an alternative plan <br />approved by DWR. <br />Very truly yours, <br />Connie N.
