MANAGEMENT <br />REcE NED <br />JAN G : m ? <br />Uwt3wi <br />o � a dcSafety n <br />Mining <br />Notice of violation CV- 2011 -007 was written to New Elk Coal Company LLC (NECC) for failure to <br />conduct surface coal mining and reclamation operations only as described in the approved application. One <br />abatement step required by December 26, 2011 was to submit a plan to restore the new development waste <br />disposal pile to approved designs. This technical revision application will formalize the plan to restore the <br />development waste disposal site to approved designs. <br />NECC plans expand to the development waste disposal area (DWDA) and install a conveyor system that <br />will transport development waste from the east side of the development waste disposal pile to the refuse <br />disposal area conveyor. The new temporary conveyor system will be permitted under minor revision <br />number 101. <br />This technical revision application provides for the expansion of the DWDA. There is a topsoil stockpile <br />located immediately west of the DWDA. That topsoil stockpile will be relocated to an approved topsoil <br />storage area. The DWDA will then be expanded to the west. The footprint of the DWDA increases 1.4 <br />acres from 3.0 to 4.4 acres. <br />Exhibit 39 presents the drainage calculations for the expanded disposal area. Figure 2e development waste <br />disposal area routing shows the ditches surrounding the DWDA. The ditches are also shown on Map 13 <br />Sheet 1. <br />This technical revision will also facilitate the installation of the conveyor system. Three new culverts will <br />be installed along the proposed conveyor corridor. The haul road located north of the development waste <br />disposal area will be extended to the proposed loading point for the conveyor. The classification of an <br />access road located south of the coal preparation plan will be changed to a haul road. <br />Fourteen culverts were added to Map 13 Sheet 1, based on a survey of existing culverts and in anticipation <br />of the installation of culverts in the future. Exhibit 19(18) presents the culvert sizing rationale and <br />calculations for the new culverts. <br />Table 20 was amended to add the flow rates and ditch sizes for the ditches located north and south of the <br />DWDA (D12 & d14). Table 21 was amended to list the new and enlarged culverts. <br />
