December 21, 2011 <br />BLUE EARTH <br />Colorado Department of Natural Resources <br />Division of Reclamation, Mining and Safety <br />Attn: Mr. Berhan Keffelew <br />1313 Sherman Street; Room 215 <br />Denver CO, 80203 <br />RECEIVED <br />DEC 222011 <br />Division of Reclamation, <br />Mining & Safety <br />RE: Response to Adequacy Review Comments for Schmidt Construction Company <br />Fountain Pit, Permit No. M- 1982 -155, Amendment No. 1 <br />Dear Mr. Keffelew: <br />The following discussion and attachments are submitted on behalf of our client, Schmidt <br />Construction Company, in response to the Adequacy Review comments prepared by the Division <br />of Reclamation, Mining and Safety dated October 25, 2011 for the Fountain Pit 112 Construction <br />Materials Reclamation Permit application. The information and discussion below addresses each <br />comment as it was presented by the Division: <br />6.4.4 Exhibit D — Mining Plan <br />1) The Mining Plan — Exhibit D and the Pre - Mining and Mining Plan Map — Exhibit C have <br />been revised to remove the mining options and include only one mining plan. <br />2) During the majority of the mining operation, surface water from the pit will not drain <br />from the permit area. Only at the very end of the reclamation activities will the mine pit <br />area be graded and stabilized to allow surface drainage off of the permit area. During the <br />mining and reclamation period, the appropriate stormwater discharge permit will be <br />obtained from the Colorado Department of Public Health and Environment and the <br />associated monitoring and stormwater management plan will be followed for surface <br />water discharges. <br />3) Due to the relatively small size, portable processing equipment will be used during <br />mining of the amendment area. All conveyors will be associated with the portable <br />processing facility. Haul trucks, not conveyors, will be used to transport raw material to <br />the processing facility. <br />For the reclamation warranty, we believe that the portable conveyor could be removed <br />with no cost to the Division. No footings or anchors will remain that could significantly <br />add to reclamation costs. <br />6.4.5 Exhibit E — Reclamation Plan <br />1) The Reclamation Plan — Exhibit E and the Reclamation Plan Map — Exhibit F have been <br />revised to remove the reclamation options and include only one reclamation plan. <br />
