OBSERVATIONS <br />PERMIT #: M- 1986 -124 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: December 13, 2011 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). The Operator was not present for the inspection. The Cecil II Gravel Pit is located approximately 5.5 <br />miles northeast of Cope, Colorado. The site is located on the Arickaree River and is permitted for 9.9 acres. <br />The post- mining land use is general agriculture. <br />Financial Warranty: <br />The Division currently holds a financial warranty in the amount of $7,500, which has been determined to be <br />sufficient to complete reclamation. <br />Reclamation Success: <br />Mining at the Cecil II Gravel pit was completed in 2005; the Operator notified the Division in writing on <br />January 25, 2006 that reclamation of the site was commencing. Construction Materials Rule 3.1.3 requires <br />Operators to complete reclamation with all reasonable diligence within 5 years from the date the Operator <br />informs the Division that reclamation has commenced. The failure to fully reclaim the site within 5 years has <br />been cited as a problem; please see the first page of this report for additional information. <br />The Division conducted a previous inspection on August 16, 2006 and found that reclamation had been <br />completed in accordance with the approved Reclamation Plan. However, several items were cited in the <br />report which were to be addressed prior to final release of the site. The following are outstanding items which <br />must be addressed by the Operator prior to final release of the site: <br />a) The Operator must reclaim the small cut in the hillside near the entrance of the pit (approximately 100 feet <br />long and 6 feet high), or provide written verification that the disturbance was created by the landowner for <br />purposes other than mining. <br />b) The Operator must provide written consent from the landowner which allows the concrete near the site <br />entrance and the abandoned car to remain in place following the release of the performance and financial <br />warranties. If the Operator is unable to provide written consent from the landowner, then the concrete pile <br />and the abandoned car will need to be removed from the site. <br />During this inspection the Division observed that material had been removed from the pit recently. This was <br />evident by fresh tire tracks leading into the pit. In addition, the bed of the Arickaree River drops approximately <br />two feet at the point where sand has been excavated. The Division is aware that the Operator is located out of <br />state and no longer has a presence at the site. The Operator should note they will be responsible for <br />reclamation of the site, including disturbance which was created by other parties utilizing the pit. The <br />Reclamation Plan states the sand and gravel deposits within the Arickaree channel will be leveled. Therefore, <br />the Operator must level the deposits within the Arickaree channel prior to final release of the site. <br />This concluded the inspection. <br />Page 2 of 4 <br />
