General <br />1. The final paragraph states that since the changes in reclamation in Stages 2A and 2B are <br />landowner driven the Operator has no obligation to maintain or upkeep improvements. To <br />clarify, the Operator is not required to maintain or upkeep facilities owned by a separate party <br />(i.e. Irrigation system, bike track, storage building etc.) but the Operator is responsible to insure <br />that reclamation is completed to the requirements of the approved reclamation plan and to follow <br />the performance requirements of the Construction Materials Rules and Regulations. <br />The decision date for this application has been set for December 28, 2011 provided all issues have been <br />addressed. To allow adequate time for staff review DRMS is requesting the applicant to submit a <br />decision date extension request extending the decision date to January 11, 2012.
