General
1. The final paragraph states that since the changes in reclamation in Stages 2A and 2B are
landowner driven the Operator has no obligation to maintain or upkeep improvements. To
clarify, the Operator is not required to maintain or upkeep facilities owned by a separate party
(i.e. Irrigation system, bike track, storage building etc.) but the Operator is responsible to insure
that reclamation is completed to the requirements of the approved reclamation plan and to follow
the performance requirements of the Construction Materials Rules and Regulations.
The decision date for this application has been set for December 28, 2011 provided all issues have been
addressed. To allow adequate time for staff review DRMS is requesting the applicant to submit a
decision date extension request extending the decision date to January 11, 2012. If a request to extend the
decision date is not received by December 20, 2011 or the application may be denied.
If you need additional information, please contact me at the Division of Reclamation, Mining and Safety,
Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, telephone no.
(970) 241 -2042.
Sincerely,
- The revisions to the reclamation plan proposed in TR -05 will be incorporated into the
approved reclamation plan once all issues are resolved. When the revision is approved and
the changes are incorporated into the approved reclamation plan it is the operator's
responsibility to insure that reclamation is completed to the requirements of the approved
reclamation plan and to follow the performance requirements specified in the Construction
Materials Rules and Regulations.
ec: Steve Shuey, DRMS
4
Travis Marshall
Environmental Protection Specialist
