I. Objections: <br />The Division received a timely objection from the following during the initial public <br />comment period which closed on June 29, 2011. <br />Commenting Party Date Received <br />Dennis J. Smith June 29, 2011 <br />II. Issues Raised by Objector: <br />Representing <br />Self (adjacent landowner) <br />The issues raised by the commenting party are summarized below. The issues are <br />followed by the applicable section(s) of the Colorado Mined Land Reclamation Act <br />and /or the Mineral Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for Hard Rock, Metal and Designated Mining Operations. The Division then <br />provides a response to the issues raised by the Commenting Party. Issues that staff <br />believes are not within the jurisdiction of the Division of Reclamation, Mining and Safety <br />or the Mined land Reclamation Board are listed last. <br />A. ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />1. "The entire mine site is a collection of old cars, old trailers, steel piles, piles of <br />garbage and old broken down equipment. I can't imagine they will take much care <br />in final remediation if they start with the mess that is currently there." <br />C.R.S. 34- 32- 116(d) All refuse shall be disposed of in a manner that will control <br />unsightliness, or deleterious effects from such refuse. <br />Division's Response: <br />The Division conducted an inspection of the site on October 14, 2010 and noted that a <br />significant quantity of various dilapidated vehicles and equipment, and other such <br />refuse was present in the area to be added to the affected area through CN1. Some of <br />the equipment and refuse appeared to have been related to the mining operation. <br />Subsequent the Division's October 14, 2010 inspection, the Operator completed a <br />substantial amount cleanup at the site. On November 7, 2010 approximately 38 tons <br />of scrap metal, including old vehicles and equipment, were removed from the site. <br />On June 16, 2011 the Division conducted another inspection of the site and <br />documented that significant cleanup of the site had occurred. <br />
