DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
December 21, 2011
Tom Cavanaugh
AMEC
2000 S Colorado Blvd, Suite 2 -1000
Denver, Colorado 80222
Re: Monogram Mine, M- 1978 - 222 -UG, Inspection Minor Infraction Abatement, and EPP Construction Schedule
Requirements.
Dear Mr. Cavanaugh,
On November 28, 2011 the Division of Reclamation, Mining, and Safety received photo- documentation from
Nuvemco that the temporary erosion control features required had been installed. Based on the pictures and
report the Division considers the minor infraction abated.
On a related issue, the Division wishes to advise Nuvemco that with the final approval of the new rules in October
of 2010 certain aspects of environmental protection plan (EPP) implementation became more defined. All
Designated Mining Operations must have EPPs and Nuvemco has been on the forefront in meeting those
requirements. However, when the EPP was approved a construction schedule for critical environmental protection
facilities was not addressed. This was primarily due to the uncertainty of what was going to be required within the
new rules for EPPs. Moving forward, any new EPPs or permits will be required to comply with the current rules
regarding construction schedules of environmental protect facilities.
At this time, the Division is requesting Nuvemco review the EPP for this and any other of its permitted sites to
determine what environmental protection facilities should be constructed now. The critical facilities at this time
without active mining are the stormwater control structures. Ore storage pads and handling structures will be
required to be built prior to ore excavation on site. Please review Rule 6.4.21 (10), Rule 6.4.21 (15), and Rule 7.3 to
ensure the structures previously approved comply with the requirements. Nuvemco will need to submit a
Technical Revision by no later than March 1, 2012 that addresses any deficiencies in design and establish a
construction schedule for when weather allows.
If you need additional information please contact me at the Division of Reclamation, Mining and Safety, Grand
Junction Field Office, 1015. 3rd St., Suite 301, Grand Junction, Colorado 81501, or by telephone no. 970.241.1117.
G.
