Based on the pictures and <br />report the Division considers the minor infraction abated. <br />On a related issue, the Division wishes to advise Nuvemco that with the final approval of the new rules in October <br />of 2010 certain aspects of environmental protection plan (EPP) implementation became more defined. All <br />Designated Mining Operations must have EPPs and Nuvemco has been on the forefront in meeting those <br />requirements. However, when the EPP was approved a construction schedule for critical environmental protection <br />facilities was not addressed. This was primarily due to the uncertainty of what was going to be required within the <br />new rules for EPPs. Moving forward, any new EPPs or permits will be required to comply with the current rules <br />regarding construction schedules of environmental protect facilities. <br />At this time, the Division is requesting Nuvemco review the EPP for this and any other of its permitted sites to <br />determine what environmental protection facilities should be constructed now. The critical facilities at this time <br />without active mining are the stormwater control structures. Ore storage pads and handling structures will be <br />required to be built prior to ore excavation on site. Please review Rule 6.4.21 (10), Rule 6.4.21 (15), and Rule 7.3 to <br />ensure the structures previously approved comply with the requirements.
