E IVED <br />DEC 2 1 2011 <br />(2 <br />and Safety <br />U.S. DEPARTMENT OF AGRICULTURE <br />Forest Service <br />TEMPORARY SPECIAL - USE PERMIT <br />(FSH 2709.11, sec. 54.6) <br />AUTHORITY: <br />FEDERAL LAND POLICY AND MGMT ACT, AS AMENDED October 21, 1976 <br />Authorization ID: COL637 <br />Contact ID: WILDCMC <br />Expiration Date: 08/01/2012 <br />Use Code: 753 <br />WILDCAT MINING CORPORATION, hereinafter called the Holder, is hereby authorized to use, subject to <br />the terms and conditions of this permit, National Forest System land identified within the unit area and <br />described as Sec. 28, T. 36 N., R. 11 W., NMPM, as shown on the attached Exhibit A. This authorization <br />covers approximately 0.3 acres. <br />The holder is authorized to conduct the following activities and/ or install the following temporary <br />improvements on the permitted area: <br />Short term access across National Forest system lands on the existing travel route known as the Little <br />Deadwood trail or Forest Road 571A. This permit authorizes unlimited temporary road use foot, light -duty <br />vehicles (standard pickup and ATV), and does not authorize grading. Snowplowing is authorized up the <br />to last switchback curve, before the Forest Road.enters the Lynx Habitat polygon shown on the attached <br />map. Additionally, this permit authorizes limited use by heavy equipment for which there is a work plan <br />approved by Colorado Division of Reclamation and Mining Safety attached to made part of this permit. <br />Approved equipment at this time includes: backhoe, front -end loader, excavator, two drill rigs, bull dozer, <br />haul trucks, fuel truck, and grizzly. This permit may be amended upon verification of further DRMS work <br />plan approvals. The purpose of this temporary access to the Idaho and May Day mine and mill complex <br />is for completion of due diligence and /or remediation actions in connection with Wildcat Mining's pending <br />state mining permit. <br />TERMS AND CONDITIONS <br />1. Use under this permit shall begin on 12/01/2011 and end on 08/01/2012. The permit shall not be <br />extended. <br />2. The holder shall conduct the authorized activities according to the attached approved plans and <br />specifications. <br />4. The holder shall not install any improvements not specifically identified and approved above. <br />5. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands <br />without specific prior written permission from the authorized officer. <br />6. The holder shall comply with all Federal, State, county, and municipal laws, ordinances, and <br />regulations which are applicable to the area or operations covered by this permit. <br />7. The holder shall maintain the improvements and premises to standards of repair, orderliness, <br />neatness, sanitation, and safety acceptable to the authorized officer.
