Dear Mr. Trujillo:
The DRMS' letter dated December 6, 2011 transmitted its adequacy review for the referenced
technical revision. On behalf of New Elk Coal Company, (NECC) following are its responses to the
DRMS' comments and concerns:
1. DRMS - Please provide an updated Map 11 -Sheet 1, Map 11 -Sheet 2 and Map 11 -Sheet 3
removing Slurry Wells 2 and 3 as approved by MR-102.

NECC - Slurry wells 2 and 3 have been removed from the maps.
2. DRMS - Please provide an updated Map 11 -Sheet 1, Map 11 -Sheet 2 and Map 11 -Sheet 3
removing the RWDA expansion proposed in TR -60. From discussions with Jim Stover, the
RWDA expansion proposed in TR -60 is subject to change and has yet to be approved by the
Division.
NECC - The RWDA expansion area has been removed for the maps.
3. DRMS - At the south end of the proposed SAE, please explain the drainage pattern, especially in
regard to the natural channel and the railroad bed. Are these features included in the proposed
SAE?
NECC - The railroad bed is included in the SAE. The clean water diversion flows south of the
railroad bed and is not included in the SAE. See Figure 1 discussed below.
4. DRMS - Please provide a larger scaled map to better define the drainage patterns within and
adjacent to the proposed SAE.
NECC - A Figure 1 that shows the drainage patterns is included to support the SAE calculations.
The figure is the last page of the SAE calculations (Exhibit 19(17) -10).
