The Division posted the non - confidential Form <br />2 on the Office website on November 29, 2011 in accordance with the requirements of Rule 5.1.3. Any <br />public comment or request for disclosure of information designated as confidential regarding the <br />Modification had to be received by the Office no later than ten (10) working days after the notice was <br />posted on the Office website (December 12, 2011). No comments or request were received. <br />The Division has reviewed the modification and notes only two deficiencies. The first is proof of notice <br />to Montrose County. The Division notes that Energy Fuels has indicated the proof is in the mail to staff. <br />The second deficiency is the reclamation bond. Staff has calculated the reclamation liability for the <br />Farmer Girl 2 to be $5,745.00. The update is an increase of $2920.00 over the $2825.00 currently held. <br />The estimate includes secondary seeding of any original areas and the cost associated with the proposed <br />new activities under MD -01.
