3. The landowner has expressed a desire to use the pit floor areas for storage and other purposes <br />in the future. Western does not need to focus on this area, but must maintain grading and <br />ensure gravel materials are left in place sufficient to control erosion. <br />4. Western must protect the existing topsoil. If the materials are saturated or frozen Western <br />cannot attempt to place them on reclaimed slopes. Wet or frozen topsoil handling will destroy <br />the material profile and cause more work and expense to Western in the long run. <br />5. Based on the time of year and weather conditions it is not advisable to attempt revegetation <br />work. If weather conditions change to allow seeding Western and the Division can discuss at <br />that time. <br />6. All Western Gravel equipment, mining related debris, and other assigned property must be off <br />site by 5:00 PM on January 31, 2012. <br />Western must agree to these conditions and submit its acceptance in writing no less than 24 hours prior <br />to initiating the work. Western must also submit a weekly activity report via email to the Division as to <br />what tasks are being conducted and completed. The Division reserves the right to inspect the work at <br />any point during the reclamation process unannounced and halt activities if they are determined to be <br />detrimental to final reclamation of the property.
