OBSERVATIONS <br />PERMIT #: M- 2001 -012 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: December 13, 2011 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Jason Lockard and Clint Mehring of the Washington County Road and Bridge District were also <br />present for the inspection. The Shook Gravel Pit 1 is located approximately 10 miles southwest of Akron, <br />Colorado. The site is permitted for 270 acres and the post- mining land use is rangeland. <br />Gen. Compliance With Mine Plan: <br />The site was inactive at the time of the inspection; no equipment was present on site. Mining operations at <br />this site commenced in the NW1 /4 of the SW1 /4 of Section 26. The pit is approximately 10 acres in size and is <br />situated on the west side of the Brunker Creek. The pit walls have been graded to 3H:1V or flatter and the <br />Operator plans on seeding this area in the spring of 2012. According to the approved Mining Plan, the <br />Operator would concurrently mine two separate areas, not to exceed 10 acres in size for each area. The <br />Operator is in compliance with this provision of the Reclamation Permit. During the inspection, the Operator <br />inquired about revising the requirement to maintain no more than two active mining areas which do not <br />exceed 10 acres in size. The Division informed the Operator the conditions of the Mining Plan could be revised <br />at any point during the life of the mine by submitting a Technical Revision to the Reclamation Permit. <br />The Division observed rills and gullies around the entire perimeter of the reclaimed pit. Several gullies along <br />the western pit wall were approximately 3 feet wide and 2 -3 feet deep. The pit walls are eroding into the pit; <br />no material is being transported off -site. The lack of established vegetation throughout the pit has contributed <br />to the observed erosion. Construction Materials Rule 3.1.5(3) states that all grading shall be done in a manner <br />to control erosion and siltation of the affected lands, to protect areas outside of the affected land from slides <br />and other damage. The eroded areas on the pit walls have been cited as a problem and will require corrective <br />action by the Operator; please see the first page of this report for additional information. <br />The Operator is currently mining an area immediately south and west of the reclaimed pit. The area of active <br />mining is located outside of the channel of Brunker Creek on the east side. According to the Operator, no <br />mining will occur within the channel of Brunker Creek. However, the approved Mining Plan indicates mining <br />will occur within and immediately outside of the channel of Brunker Creek. The Reclamation Plan Map shows <br />the land immediately adjacent to Brunker Creek will be mined and that the pit walls will be reclaimed to 3H:1V <br />and will slope toward the channel of Brunker Creek. The failure to follow the Mining and Reclamation Plans <br />has been cited as a problem and will require corrective action by the Operator; please see the first page of this <br />report for additional information. <br />Roads: <br />The Mining Plan states that three roads will be constructed at the Shook Gravel Pit 1. The Operator has <br />constructed a single road which runs north from County Road 31 to the pit located in the NW 1/4 of the SW <br />1/4 of Section 26. The access road is approximately 320 feet in length and 30 feet wide. All constructed roads <br />are to be reclaimed during final reclamation of the site. <br />Signs and Markers: <br />The permit sign was posted at the site entrance and the boundary of the affected land was clearly delineated <br />as required by Construction Materials Rule 3.1.12. <br />This concluded the inspection. <br />Page 2 of 4 <br />
